In the Federal Court today,Ms Jackson,the National Secretary of the HSU,launched a last-ditch attempt to scuttle plans to place the branch into administration.
Her barrister,David Rofe,QC,applied to file an affidavit of Ms Jackson that would reopen the case,claiming she had not had a fair trial.
Justice Geoffrey Flick rejected the application and proceeded to hand down a 78-page judgment.
Outside the court,Ms Jackson said it should be left to the membership to decide if the East branch should be demerged into three parts,not the court.
"Obviously I'm really disappointed with the outcome. What I just want to remind our members is the amalgamation of the union did not cause the corruption in HSU East and I was quite surprised by the judge's decision,"she said.
"That's a question for the membership. The membership should decide whether there should be a demerger of the union or whether we should stay together as one big union,"she said.
When asked what extra material she unsuccessfully attempted to have Justice Flick look at today,in order to reopen the case,Ms Jackson said:"I haven't submitted any material - that's my whole point. My affidavit has been knocked back,my contentions have been knocked back."
