Mr Sims said the regulator was still deciding whether the release of the data would be enough to address any competition concerns.

“We have not formed a final view on the competitive impact of the proposed acquisition or
whether the undertaking is capable of addressing any potential lessening of competition,” he said.

A Transurban-led consortium and another spearheaded by IFM Investors lodged final bids with NSW Treasury last month to buy a 51 per cent stake in WestConnex.

Transurban boss Scott Charlton told investors on Tuesday that the company was confident of gaining approval from the competition regulator.

Macquarie analysts have also said that the longer it takes the regulator to make a decision,the more likely it is that the Transurban-led consortium would emerge the winner.

Transurban owns seven of the nine toll roads in Sydney.
