"The appropriate ultimate finding is that Mr Greenfield and Mr Alex may have committed offences under section 249B of the Crimes Act 1900 (NSW),"the submission says.
But embattled NSW secretary,Brian Parker,nicknamed"Sparkles"because he supposedly likes rubbing shoulders with the rich and famous,is unlikely to be recommended for criminal charges due to a lack of evidence.
In submissions to commissioner Dyson Heydon,counsel assisting the Royal Commission into Trade Union Governance and Corruption has concluded that Mr Greenfield and Mr Alex may have committed criminal offences of bribery.
The commission barristers say Mr Greenfield"regularly received cash payments of $2500 from Mr Alex and[his former associate Joe] Antoun during 2013,and may have received other cash payments before that time".
"Mr Greenfield received that cash as an inducement or reward for showing favour to Mr Alex and Mr Antoun and the businesses associated with them in relation to the affairs of business of the CFMEU,including facilitating the creation of new[enterprise bargaining agreements] and not treating those businesses as aggressively as he otherwise could when they owed workers money.
"The impugned payments were corrupt according to normally received standards of conduct."
